Termination of the Incumbent President’s and Government’s Terms

Grounds and Mechanisms for Termination

The term of an incumbent President may be ended before the conclusion of the constitutional term only through one of the following two routes and only on substantive grounds, such as a severe and deliberate violation of the budget laws, a breach of the Constitution, or grave harm to national security.

  1. Parliamentary Route - Removal by the Sanhedrin

    A proposal for removal must be submitted by a Sanhedrin committee and approved by the full chamber through a qualified majority of three quarters of all serving members.

  2. Direct Route - Citizens’ Initiative

    At least one third of all registered eligible voters in the state must sign a verified digital petition formally calling for the President’s removal.

    For this purpose, the state will make its secure online voting system - the Public Ledger - available to the public.

Referendum on Removal

Once verified signatures have been obtained from one third of all eligible voters, the Speaker of the Sanhedrin must immediately call a nationwide referendum on confidence in the President, to be held within 90 days.

The President’s term will end only if:

  • More than 50 percent of the valid votes cast support removal; and
  • At least 60 percent of all registered eligible voters in Yehodaya participate in the referendum.

Frequency Limitation and Prevention of Paralysis

To ensure governmental stability and prevent political persecution, the removal process - whether through the parliamentary or direct route - may be initiated no more than once during any two-calendar-year period, calculated from the date on which the President assumed office.

Continuity of Government and Caretaker Government

  • Once a final decision has been made to remove the President, whether by the Sanhedrin or through a referendum, the President’s term will end immediately.
  • The serving Vice President will immediately be sworn in as Acting President. The Acting President’s responsibilities will be limited to the routine administration of the state and the organization of an expedited presidential election within 90 days.
  • The end of the President’s term will automatically terminate the terms of all government ministers appointed by that President.
  • To prevent a governmental vacuum, the dismissed ministers will continue temporarily as a caretaker government, without authority to initiate new projects or issue new regulations, until the new President and government are sworn in.
